RIYADH — The Qiwa platform, under the Ministry of Human Resources and Social Development, stated that an employee whose status has changed to ‘absent’ due to a report of absence from the ministry, or a report of work interruption, or termination of the contractual relationship, may transfer to another employer through Qiwa, provided that they have spent more than 12 months in the Kingdom. The new employer must have to meet the employee’s any outstanding work permit fees. The Qiwa confirmed that contracts cannot be created through the platform for government employees until they complete the clearance procedures and close their registration with the government entity through the Masar platform. It clarified that an employee may be excluded from an establishment if their status in Absher or Muqeem is listed as “left and did not return” or “final exit.” The Qiwa clarified that disputes between the parties to a contractual relationship fall outside its jurisdiction. Such disputes can be addressed through the amicable settlement service at the Ministry of Human Resources and Social Development or by referring the matter to the labor court. It indicated that access to “Qiwa” is through “Nafath,” while the group manager can authorize other users through the “User Management” service, granting them access to the organization’s services according to their assigned permissions. It emphasized that Qiwa is an electronic platform and that paper documents are neither accepted nor validated through it. It also clarified that, to issue a work permit, the organization’s entity must not have remained in the red zone for eight consecutive weeks, with the exception of newly established companies.
